Chapter 7 - Surrendering Real Property - Form 22
Hi everyone,
I have a trial attorney at the OUST who is insisting that a debtor in a
chapter 7 cannot deduct their mortgage payments on Form 22 because they are
surrendering their property.
I thought this issue was settled ages ago.
Does anyone have any case law citations handy, or something else, that I can
send over to this trial attorney to educate them?
Or - if I am wrong -- a referral to a neurologist would appreciated.
