No, you need to respond to the MRS, unless the debtor is going to surrender the
home. There is a form on the Courts website to use for the response. The Order
for Relief usually applies even in the case of a conversion. You need to
respond 14 days ahead of the hearing. If the Debtors are going to do a loan mod
you can do a limited opposition and provide proof of the modification and
suggest the Court grant the relief 14 days after the discharge on the basis it
will facilitate loan negotiations.

Hi CDCBAA mates:Confirmed chapter 13 and bank has just filed a MRFS. I called
the debtor and as you have it, he hasn't paid his mortgage or his chapter 13
plan payment. Debtor not likely to come up with payments. My question is what
will happen to the MRFS hearing if the debtor converts to a chapter 7? Will it
be continued? Thanks.
