Shawn:
I believe your guy is not disabled. Disabled is unable to work. If working and getting treatment, not disabled yet. Wait till he cannot work.
If you want to check this, search the two statutes in computer search engines.

What constitutes a disability for exemption purposes - debtor has cancer

The debtor wants to file a Ch 7 but has too much equity in his home. The increased exemption for disable debtors would make the difference.
The debtor is self employed and still active. He is not on Social Security or any other kind of disability program. He has cancer - he has been and is still undergoing treatment but it is likely going to be fatal.
Is this a disability and if so how is it documented for bankruptcy purposes - what evidence is required to take the increased exemption?
Thank you.
Shawn
