It sounds as if the client was in a trial modification period. Generally, the paperwork I have read states that the filing of a bankruptcy during the trial period will void the trial modification and therefore jeopardize the possibility of a permanent modification. More likely than not the court will deny the suggested motion as the real property collateral for the loan is not being administered by the trustee and does not effect the estate; questioning the jurisdiction of the court to issue an order. It is similar to a motion to approve a short sale after a no asset report. Been there, done that, been denied!
