Pre-filing planning for sole proprietorship

Matthew, I believe your question says that its a lady who is running a small business out of her home. I just dealt with a woman who is running a small candlemaking business out of her home; it barely turns a profit. Thats one category of small business thats easier to handle.
I don't expect to see the same issues and problems as I would if it was a contractor who operated out of the home. So the amount of pre-petition planning depends on the annual income and the nature of the business.. I look at the tax returns, and ask about whether there is inventory,equipment and look at the gross profit and bank account. If they are currently operating, I need business income and expenses detailed. You certainly charge a great deal more and need help from an experienced bk person if the business falls into this second category because there are some tricky issues you might not expect and business clients often want to lock you into a lower fee and minimize the difficulties.

David and Matt:
I disagree that it is an improper question, but I do think it a good example
a case where you should request someone that is knowledgeable in this area
(that most definitely is not me) to associate in so they get paid and keep
you from malpracticing. The reason they need to get paid is that questions
will be endless in a more complex matter and they will be teaching you
something valuable while keeping you from violating your ethical duties.
The line between questions that are asking too much and those that are not
are not crystal clear. The board will be attempting to set up some
guidelines and protocols for these sorts of things. While they will not be
binding in the sense that an experienced practitioner cannot give away his
or her time wholesale, they will make it clearer when one should be looking
to associate someone in or at least not be surprised that the response to
the question is that the person should associate with someone more
knowledgable.
