I guess the amount of equity husband acquired in his barely profitable business would determine if I would wait another 6 months. Maybe the In re Bledsoe, 569 F. 3d 1106 case that was just decided a few months ago would help in your analysis.
As for the agreement, I have seen a few divorce cases where 5(b) was marked "division of property pursuant to prior legal separation agreement, case no. ???- agreement attached." This way you would have the divorce, but the prior agreement with the prior date would be recognized by Superior Court.

PC originally filed for legal separation in 2008; Granted less than 6
months old; Agreement provides the husband kept his business property (with
equity)and barely profitable business and the wife came out with no alimony
after 15 years, both kept their own debt. Now she wants to file a Chapter
7. They have religious reasons for a legal separation. Would she be better
off delaying her filing for another 6 months?
Another option is that I can convert the legal separtion into a disso and
use the same Agreement but that would have a more recent date. Suggestions?
