Good afternoon Listmates,
I have a case where the Debtor transferred (pre-petition) a vehicle to her
ex-fiance after the loan was paid off. When vehicle was purchased, debtor
had good credit and that is why the Debtor financed the vehicle. The
ex-fiance always paid for, registered, maintained, operated and insured the
vehicle. I have never had an issue filing a case in this situation and so
we moved forward with the filing.
We have documentation showing the ex-fiance has an ownership interest, e.g.
checks showing payment, insurance declarations, registration etc. At the
341 hearing in December, the trustee said that he was going to look into
the transfer of the vehicle. We weren't concerned because we have the
documentation.
However, I have attempted to reach out to the trustee to provide
documentation and discuss the situation. The trustee has not responded.
Today, the trustee filed a Application to Employ. Any thoughts or previous
experience? Thank you in advance!
