Friends and Colleagues:
Your financial support is desperately needed. If you opened this, then you
have by now gotten used to me pestering you about SB 308, the California
bill introduced by Sen. Rob Wieckowski (a bankruptcy attorney as well as a
state senator) to both increase the current $75,000/$100,000/$175,000
homestead exemption to $100,000/$150,000/$300,000 and to eliminate the
6-month reinvestment rule of *In re Jacobson*.
Last Fall, 29 Democrats abstained from voting in favor of SB 308 Why?
It turns out all the letter-writing, emails, and calls of support from
consumer advocates and constituents was no match to the powers of
lobbyists. After looking into the unexpected outcome, SB 308 supporters
learned that lobbyists for the collection agencies and debt buyers targeted
Democrats in the Assembly for some off-the-record, behind closed doors
arm-twisting to urge them not to go along with those bankruptcy lawyers who
only sought to advance the interests of their wealthy debtorwhich 23 Democratic Assembly members were targeted? Those from rural
districts and districts with large Hispanic populations, constituents seen
as most receptive to the notion that only wealthy urban debtors stood to
benefit and that increased homesteads would harm honest consumers who pay
their debts. Balderdash!
But SB 308 did not die. A motion for reconsideration was granted and it was
moved to the inactive file. Now its back and were smarter. How do you
fight fire? With fire. With the support of the National Association of
Consumer Bankruptcy Attorneys (NACBA), which has provided seed monies to
get the effort off the ground, Senator Wieckowski and California NACBA
leaders have enlisted the assistance of a lobbying firm with a proven track
record that has agreed to substantially discount its fee to $40,000. NACBA
has put up $10,000, and the grass roots efforts of others have brought the
effort to within $10,000 of the $40,000 mark (less if pledges from
supporters come through).
Our lobbyist is on the job and making headway. Just this past week we
picked up support from the United Food and Commercial Workers Union and the
Los Angeles County Democratic Party. These groups join a growing list of
Labor and other organizations lending their support and boots on the ground
to get SB 308 passed.
But more is needed and time is running out. If the $40,000 retainer is not
raised, the NACBA conditional donation is lost. Our clients cannot afford
to lose again, and unlike a cat, SB 308 does not have nine lives. This is
its 3rd (and perhaps last) shot. So I am asking you to do what Ike Shulman
(co-founder of NACBA) and several others have done. Donate to the effort
to pass SB 308 and bring about long-overdue reforms, ending the *In re
Jacobson *nightmare. Many firms have donated between $500 and $3,000. Itnot easy to give with filings down and business slow, but consumer debtors
have been our clients, our bread n butter for decades. They need this
help! Even if you cant give $500, your $250 or even $100 donation will
help.
