court order (This is why the code says you cannot
separate just to pass the means test, a bad faith
issue).
Go ahead and use only one income.

Prospective chapter 7 debtor filed divorce proceedings over a year ago.
Although they have been living separate and apart, with support payments and a
mediated division of property and debts, as of today, they are not divorced --
there is no bifurcation. In calculating CMI, are both incomes for the
6-month period counted or just the income of the filing spouse ? Does it help if
the entered order on the mediation indicates that their income is separate
property?
