Should be easy to do. Key is abandonment notice which you referenced. If
all else fails, file motion asking the Court for Order confirming that
property has been abandoned under Sect. 554.

have ch 7 filed under old law. in jan. 07, trustee filed notice of intent
to abandon property for debtor's house. it's upside down. nothing on pacer
since that filing. trustee may still be pursuing action against vegas hotel
to recover gambling markers, so case is still technically open though debtor
has no assets.
he wants to re-fi his house. mortgage holder won't talk w/him until he gets
a letter from the court that his case is closed. they won't accept the
discharge. any ideas of what can be done.

debtor's house. it's upside down. nothing on pacer
since that filing. he wants to re-fi his house.
vicki, look at the notice. Most say if no objection,
deemed abandoned after 15 days. File a scream or die
motion to compel abandonment. Attach the notice as
an exhibit, and state in your own declaration you have
checked pacer and there was no objection (if true).
Depending on the Judge, if you get a signed order, you
are home free. Problem is a judge could consider the
order a comfort order and refuse to sign. If trustee
won't sign, use a scream or die motion for an
abandonment order.
