I would like to ask the group if anyone has seen or been a party to a US Trustee Motion to Dismiss a business (or tax) debt case for cause under Section 707(a) because there was a large net income under Schedules I and J. I believe Peter Anderson at a seminar last year stated that his office would file such motions in appropriate cases, but I have not personally seen one. Has anyone? The subject did not some up on Saturday, but it is my impression that the UST offices in this district are focuing their 707 efforts only on the consumer cases, both under 707(b)(2) and (b)(3).
