Treatment of non-filing (sic) "nonfiling is correct" spouse's income

There are two kinds of preferences we have to avoid in bk (a pun),
1. The 547 preference, i.e. prepetition payments made to creditors within 90 days of the bk, etc., and
2. The preferential payment of one creditor to the detriment of other creditors in chapter 13. This second "preference" is called discriminatory treatment to keep the two from being confused.
