What bashing? An attorney simply commented that certain policies of a certain judge, polices within that judges discretion, were having an adverse impact on his clients. He could probably prove it if he had to. Why are judges immune to criticism outside of the courtroom? Especially criticism directly related to their actions in very public courtrooms? Is their a local rule against free speech?

Maybe not a bad idea to read up on what happened to Washington Post's Dave
Weigel and listserv Journolist last week. A listserv is not "private email"
and while we want to foster and encourage open discussion, it's kind of the
equivalent of posting something on a bulletin board that hundreds of people

Some clients don't have the money because they have been living beyond their means for too long. The word "capricious" denotes whimsy or unpredictability. The judge to whom you refer has neither of those characteristics. She is quite predictable. She simply has a much higher standard of personal responsibility than most. It is quite inconvenient at times, but there have been a couple over the years who were much worse.

When you have been practicing for a long time you will know that it is always possible for a judge you don't like to be replaced by somebody much worse/more annoying. Its like my 58 year old neighbor who left his long time wife and four children to marry a cute little aerobics instructor (who is now pregnant with twins)
