Abraham Lincoln, by Executive Order in 1863, attempted to make certain that no American would ever be forced into a Chapter 13 or any other involuntary servitude. It was called the Emancipation Proclamation. In order to make that order permanent after that little disagreement between the states, The Thirteenth Amendment to the Constitution became law on December 6, 1865. A debtor can, however, be forced into a Chapter 7.
