Has anyone had a case that was forced to convert to a Chapter 13?

Who is the judge? Some give the UST a lot of room (they are the government representative), some make them prove their case. Measure the judge, compile your proof, tell your client the risks, and have the client decide which route is the best for the client. If you decide, asking for a malpractice suit.
Often, I write a note and make the client sign, including what was discussed, and that the client decided which tactic we used.
