Wife files Ch. 7 and uses 704 series exemptions to protect equity in
home. One month before the filing, Husband had $12k in his checking
account. He used these funds to catch up on the mortgage and
property taxes, and sent approximately $8,000.00 to his credit card
holder's so that he would have "perfect credit". Question: could
the Ch. 7 trustee go after the $8k as a preference? Only reason we
care is because husband was opposed to wife's filing and would be
very angry if the trustee moved for the return of his payments to
his creditors.
