amending/replacing ch. 13 proof of claim
Posted: Fri Oct 08, 2004 3:25 pm
I'm filing a new proof of claim for a secured creditor in a pending Ch. 13 case. The original claim did not contain arrearages (even though the confirmed plan itself did).
My question is: Is there a difference between checking the box saying it "replaces" the prior claims, versus the box that says it "amends" the prior claim?
My concern is that we are way past the deadline for filing claims and I want to make sure this relates back.
Thanks...
