The long dreaded bankruptcy reform bill was passed by the Judiciary Committee of the United States Senate this past week. The Senate will be in recess the week of February 21st and will return on February 28th. The Senate leadership has indicated that the legislation will be a priority matter and is to be addressed by the full Senate immediately upon return. If passed by the Senate, it will almost certainly be passed by the House of Representatives and signed into law by President Bush. This email is not overly dramatic. Your ability to effectively represent your clients and to earn a living will be impaired by this legislation if it becomes law.
I urge you to take a look at the legislation now. It is seriously flawed, outdated and unbalanced. The Bill - S. 256 - has been written and paid for by the credit card companies. It was first introduced in 1997. Since that time, we have seen some of the most egregious examples of corporate fraud and resulting bankruptcies in history. We have endured terrorist attacks which have crippled our economy. We are in the midst of a healthcare crisis. The Bill has not been modified to address any of these factors. The Bill severely penalizes honest debtors but does little to restrict overly aggressive creditors.
Please consider the following:
A) The new measure would require debtors' attorneys to:
(1) certify the accuracy of the debtor's bankruptcy schedules, under penalty of court sanctions imposed personally against the lawyer,
(2) certify the debtor's ability to make payments under a reaffirmation agreement, forcing attorneys to conduct costly and time-consuming audits of their clients' finances, and
(3) identify and advertise themselves as "debt relief agencies" and then comply with a host of burdensome new regulations.
