There are cases in the annotated California Codes under the exemption (don't ask me the number because I am not in the office.) There was a seminal case a few years ago on what is not an exempt annuity. It pays to do a little old fashion research and it's not hard. Carolyn

They are retirement accounts designated by the IRC for 501(c)(3) or public school employees. They are to non-profit employees what 401k's are to employees of private employers, but not nearly as flexible as investment vehicles. The $64K question is whether they are ERISA protected, which the dim recesses of my memory tell me they aren't, but those recesses are highly unreliable.

because it's not a retirement account and other jurisdictions (so I'm told) have held the retirement exemption is inapplicable for them.
