I know a debtor who filed a Chapter 13 in 1996 and approximately 2 years
later converted to a Chapter 7 and this debtor was able to successfully file
a Chapter 7 in 2002.

Could someone kindly reaffirm my understanding that a person can file
a chapter 7 bankruptcy (second bankruptcy) if six years have past
since the last time they filed a chapter 7; and the six year ban
against refiling is counted from the date of filing, not the date of
discharge.

Yes, there is case law supporting that view. However, if there is no
urgency, why not wait as long as possible and avoid having to parse this
issue. I'm a defensive filing "debt relief agency."Carolyn
