Unpublished Opinions

See rules of court--- I once footnoted to an unpublished opinon before Geri Mund--not relying on the case, but mentioning it and she made a comment that I shouldn't have done it.
Tread carefully.
The exception is generally when its the law of the case and not much else.

I want to file a memorandum of law before trial. The issue
is "Finder's Fees." My client received one and now the trustee is
saying its a fraudulent conveyance because all she did was say "Bill
meet Fred." I have found a bunch of cases in Cal and a couple in
Federal court but most of them are unpublished. Does anyone know
how that works? I know that in general you cannot cite unpublished
opinions but aren't there exceptions? I want to educate the judge
on finder's fees, not necessarily pitch her on any particular
aspect. Thanks Jon Hayes
