Mediator Recommendations
Dear Members: I am looking for a recommendation for a mediator on the
mediation panel that you think would do well with a case where the parties
involved in the bankruptcy were in state court litigating ownership over a
single asset real estate. The State court awarded 5/8ths to one of
Debtor's creditors and 3/8ths to the debtor. The Creditor appealed, but in
the mean time in bankruptcy the property is being sold and the 3/8ths is
being held pending mediation in bankruptcy. Of course we don't want to
stay in bankruptcy for years pending the outcome on appeal and debtor wants
his funds so he can pay his debts. BUT the creditor wants it held pending
the outcome of the appeal hoping to recover the 3/8ths interest. So for
this situation, would you please email me off list with someone on the
panel that you think would be creative in helping these parties move this
along? Thank you so much.
