That claim could also be property of the estate.

And whether the severance amount is based upon the years of prepetition employment. There could be an allocation, but it would not be favorable to debtor.

Its a matter of whether the debtor's right to the severance existed at the time of filing for it to be an asset of the estate..

Before the filing of his chapter 7 case, the debtor was told he was being laid off next month or in 2 months.
He will receive $140,000 in severance pay.
Does anyone know if his severance pay can be protected/exempted?
