I'm taking a shot in the dark with this, but if anyone does any collection
lawsuit defense I'd love for you to contact me off-list.
I'm defending someone who cosigned a debt with a relative. The relative got
the creditor to voluntarily cease collections for 6 months through a
payment forbearance program, but my client didn't have anything to do with
that agreement.
The suit was filed in a timely manner as to the relative, but if the
forbearance hadn't existed then the SOL would have run out.
I'm looking at CCP 360 as a way to get my client out of it based on running
of the SOL. Can't find a thing out there to either support or refute my
position, and I'd love it if someone had any informed thoughts on the
matter.
Thanks in advance-
Jay
