Receipt of probate funds on means test

I wonder if some of the money can't be used to negotiate a settlement with
some or all of their creditors on a discounted basis?

Have a client that just disclosed to me after retaining me that.oh, by the
way.last month we received $39,000 from the probate of my husbands father
who died intestate 3 years ago which included a wrongful death claim.
It looks like the award on the wrongful death claim came several years ago,
but was just received last month, along with the remainder of the probate
after a lot of in-fighting among relatives.
Is there any way that this DOESNT get included as income on the means test?
If not, would it be best to just plead special circumstances of this being a
one-time receipt, or just wait the 6 months? (theyll have to endure
several months of wage garnishment to wait).
