I don't know how many of you get these Motions to Dismiss from the UST, but
if you file enough and take any marginal cases it is likely that you'll get
a few sooner or later.
The UST has the system down cold, as you'd expect, since it is much of what
they do. They have their model brief which has all the law which is bad for
Debtors in a menu or smorgasbord, all ready to go on a template and then
they pick the facts of our cases they think are vulnerable and plug and
play. They have a staff of analysts and attorneys to create this monster
document. We don't.
We should start an open source movement to create a similar brief ("open
source" like Linux, Wikipedia or Mozilla Firefox as examples in the tech
world) but with our arguments and case law supporting our side, updated as
the law evolves in this area. By spreading out the work, but having a
single document that we can all work on, similar to a wiki, we wouldn't have
to create our David documents to their well honed Goliath document.
I'd be willing to get the technical aspects up and rolling and try to get
the brief writing started, but I'm wondering if there are any volunteers
and/or users probable out there. Please give feedback.
