Good point. However,discharge can be entered sooner for hardship sobetter to go with Ch13.

If the debtor can show that the 2nd mortgage payment can make the difference between foreclosure or n foreclosure I would think it would be ok.
On the other hand if the person can easily afford their debt but just doesn't want the 2nd that may be a different story.
Also, are there arrearages on the 1st and/or 2nd? that would be relevant. I am gathering from your statement about the credit card being the only debt that there are no arrearages?
