Lender wants to reinstate loan mod during ch 13
Holly,
I know it's a motion and court order to approve the modification in bk. You
might find samples at yahoo in the group folders. I looked in my files and
don't have anything on the computer.
Simple though.
Might want to send a QWR [Qualified Written Request] and find out if their
up to any other funky number fabrication. Did you file the LBR Addendum?

Lender acknowledged that it made a mistake in the application of payments
under a loan mod. (It erroneously defaulted my client and scheduled a sale
date.) We filed the bk to stop the sale and put the arrears though the
plan. Now the lender admits it screwed up and wants to reinstate the loan
mod. If the lender puts the arrears back onto the back end of the loan,
debtors can do a 100% plan. Do I need court approval for the reinstated
loan mod? If so, does anyone have a sample motion they can share?
