Taking on the Chapter 13 Trustee in Riverside
charset="windows-1251"
Nancy:
Do you want cases which talk about how lawyers should not have to finance
their cases? How about cases which talk about parity in legal fees with
non-bankruptcy lawyers? There is even some really good legislative history
for the 1978 law.

Im not sure if it was Judge Naugle or Rod who pushed for a local local rule
limiting attorneys to 50% of the plan payments, but that is the case in
Riverside. I have not taken this on. I am going to start with the
supplemental fees and move on from there.
Again, if anyone has any cases to share, let me know.
Thanks,

e-mail me outside the group and I will get you the information for the attorney who took him on the same issue and won. I told him and he would be glad to share the brief with you.

I have decided to take on the chapter 13 trustee regarding supplemental
fees. As those of you who practice in Riverside know, the chapter 13 trustee
out there has established a no look fee schedule for all matters in chapter
13. They have kept the fees to attorneys down for years. I would like to
take on this issue since there are two new Judges assigned to the bench.
On a motion to value the trustee states that the avearage fee application in
the district is about $400-$500 (In re Eliapo) and they object absent any
proof of extraordinary circumstances. In re Lynn. They are also stating that
we have charged less in this division for all our other cases and site
different cases we have filed. Of course, I can site to lots of cases in LA,
WH and SA. Where we received more.
If anyone can thing of any case I must include in my brief please feel free
to let me know.

I did specify 100% and I'll have to see what they do on the recently
confirmed case. On the only other I'd have to do some accounting. I
was just told by one of Rod's attorneys that they only pay 50%. If this
is a false issue, then I apologize.

Are you sure you haven't been paid less than 50% because your plan did not
expressly specify 100% in the appropriate box? I believe I have always
received full 100% payments in my Riverside plans.
