Subject: [cdcbaa] HAMP BK Restriction??
Clients have made one of three trial loan mortgage modification payments to FLAGSTAR. They tell me they cant file bankruptcy in the trial period, but they really need to file a Ch7 before March 1. They have recently been served with a significant lawsuit relating to personal guarantees on accounts from their failed retail business. Also H has recently secured a good job and waiting three months changes the presumption under the means test.
I have read several cases that say the lender/creditor can NOT enforce a restriction on filing bankruptcy. However I did not find a case on point regarding a bankruptcy filing restriction during a loan modification trial period. I dont believe the lender can enforce a such restriction on filing, but the clients are desperate about keeping their home.
Has anyone seen a valid restriction on filing bankruptcy during the loan modification trial period?
