Dear fellow champions of the underdog:
I have a client whose vast majority of debt is from a 1999 lawsuit that
he lost suing the Pacific Maritime Association for discrimination. He
lost and the judge awarded the Plaintiff $170,000 in attorney fees.
This is a non-consumer debt, right? Between social security and
retirement payments he will pass the Means Test in a consumer case
because SS Income is not counted, but might not pass the "totality of
circumstances" test because he has a large budget surplus.
Please confirm this is a non-consumer case. I am also wondering if
anyone knows if SS Income is considered on a Schedule I and J
comparison.
