code requires last return filed, so 2009 return is not required, unless the debtor already filed it.
In practice, however, trustee can demand more info from debtor and trustee's often continue 341a's until they get the 2009 return.

It is the last filed tax return. Technically there is no cut off. However,
some trustee's are tough and ask for it. An example would be the debtor has
not filed and filed an extension. Then you would supply the 2008 return and
a copy of the extension. Be careful of tax refunds. I am seeing trustee's
prorate the refund for 2009 now.
