I would list the tax debt on Schedule E and file the Chapter 7 now. You can
file the returns later. Also, the automatic stay will hold the taxing
authorities at bay for a while (interest is accruing). Please also keep in
mind that 1/60th of the priority tax debt is a credit on the means test.
PS: I am saying its priority debt, because the returns have not as yet been
filed (2 year rule).

C7, consumer debts. Does he need to file the returns before he files the
bk? Are the IRS and FTB treated as creditors to be paid by the estate after
he files, or does he file the returns and pay them first?
