This happens with WF and certain credit unions, i.e. Financial Partners Credit Union did it also once. If I see WF or a credit union on Schedule B, upon filing I send the trustee an email requesting he/she sign the release promptly, which they have in my experience in lieu of waiting for 341/exemption deadline. In my opinion, it can even be an email and if trustee responds in the affirmative granting the release then forward that email to WF/Credit Union.

I advise clients that Wells Fargo will likely freeze the accounts. Clients can then decide if they want to pull the cash out, disclose the cash and then exempt the cash. However, claiming the exemption doesnt take the cash out of the bankruptcy estate. If the exemption claim is risky, be cautious about using the exempted cash.

They should be prepared for longer than that, in case the meeting of creditors is continued.
I think many practitioners advise opening up another account which is not Wells Fargo.

Thank you for the case law. It is an amazing read. The Nevada
bankruptcy attorney has such tenacity going after Wells Fargo. The district
court obviously has no clue that the debtors need the money to survive.
So, I guess the new rule is that client should have funds to tie them over
for at least 70 days (ie 40 days from filing - first creditor's meeting

Client does not have anything except the $5K in Wells Fargo Bank. Both
husband and wife were unemployed at time of filing and husband has cancer.
They need the money to survive every day. What makes Wells Fargo think
they have the right to stop my client from using the money to survive? If
they hold on to the funds any longer, I will scream at them on the phone
(probably will be screaming at some representative in India). At any rate,

Hasn't Wells Fargo been sanctioned for this conduct ? I thought it went up on appeal. Anyone tracking it?

case. Called Wells Fargo and they said they will freeze the account if the
