Does anyone know of an attorney in San Diego who may want to take on the following case:
Debtor files Chapter 7 in San Diego a few months ago and receives a discharge.
Debtor now wants to file Chapter 13 to strip the 2nd TD. I'm unsure if San Diego allows the stripping of junior lienholders without a discharge being allowed.
- If not allowed, how about making a Motion to Reopen the Chapter 7, vacating the Discharge and converting the case to Chapter 13?
Debtor should have been in a Chapter 13 to begin with but the bankruptcy attorney put her in a Chapter 7 instead.
