The UST has filed a motion to dismiss a same-sex CA married couple's joint Chapter 13 case under 302, alleging DOMA restricts "spouse" to opposte sex married couples. See attached.
Klee, Tuchin, Bogdanoff & Stern, LLP has been retained (pro bono) by the debtors, as co-counsel for the DOMA issue, and Robert Pfister has been designated as that firm's point person to work with me on the opposition and the anticipated appeal.
Due to the recent Public Notice regading case reassignments, this matter will apparently be heard by the honoroable Judge Donovan on May 11th.
