Legal separation vs. Divorce for filing Ch. 7 filing purposes

I recommend that you ask to see the legal separation papers. The most recent one I saw actually had filed a petition for legal separation and served it 3 years ago but thats as far as they got. Such a large percentage of family law filers are pro pers these days you have to check. Often when they say legal separation they haven't actually filed anything.

Just asking: Isn't all the community property, still community property until a decree divides it? If so, the spouses' assets would still be included.
