Taking a flyer on presumed abuse

It is somewhat against my nature to just "take a flyer" but I've had two
cases go through despite the Notice of Presumed Abuse on cases where
that nefarious box was checked on the 22A, often due to conversion from
13.
Here, my client is not passing the means test by $116, and the
non-filing spouse received a bonus of $5,000 in the period, which makes
the presumption that she earned $10,000 annually from this income. The
difference of the extra $5k is about $416 a month, which I put in
special circumstances, and if it were considered would have the debtor
pass the means test.
Any comments on this, including our odds of success?
