Has anyone tried to do an application for fees against secured
creditors after doing a successful LAM motion? (as the prevailing
party--most Promissory Notes allow fees to the prevailing party). I
think it would require sending out a stipulation prior to filing the
motion, and if not returned (and it wouldn't be) wouldn't debtor's
attorney be entitled to fees? This was recently suggested to me by
a colleague and just wondered if anyone had tried it.
