Dear Jeffrey:
There is an open question as to whether a refund due a TP who did not
make short period election can be claimed as property of the estate. The
case of Segal v Rochelle, 382 US 375, (1966)
held the refund was part of the estate. Courts since have in some cases,
apportioned the refund.
