Eric,
with a hardship discharge, no new means test, no UST involvment, I try hardship frist when income down. Do they pass the chapter 7 test, i.e. paid enough?
I had Judge Carroll grant one.

company closed. Debtor is currently receiving unemployment. During the
life of the plan, support arrears was paid, IRS debt was paid and it appears
that there is no other 523(a) debt. Employment prospects are, at best,
bleak, with no other sources of income. Debtor would have qualified for
chapter 7 at the time the case was filed. (It is not an EC case.)
