give the 2006. The trustee, however, can demand more
documentation and can hold the case open, so if the
trustee decided to ask for the 2007 return, other
provisions in 521 require it be turned over.

Marvin,
I haven't had any trouble providing the Trustee with the debtor's most recently filed tax return, but the Trustee may want to see the 2007 return before filing a no asset report.

521(e)(2)(A) provides:.. "the debtor shall provide not later than 7
days prior to MOC, a copy of the Federal Income Tax Return required
under applicable law for the most recent year ending immediately
before the commencement of the case and for which a Federal income tax
return was filed."
If a bk was filed today, would a 2006 tax return and a 2007
application for extension be sufficient.
Thanks

Believe that would be sufficient, indeed I think it would be enough without the 2007 extension given the language of the statute ("and for which a Federal income tax return was filed"), but good idea to send it anyway.
