Many concerns about judges, trustees, UST staff or other members of the BK
community are appropriate for Listserve discussion, if they are presented in
what is often described as a professional manner. As an example, I will
elevate Dennis to the bench for sake of discussion.
Example 1.
" I had a matter with Judge Mick and once again he pulled the rug out from
under my client. As usual he didn't read the pleading, he didn't rule
timely and he didn't give a reason for denying my petition-he was probably
too busy surfing. Fortunately I didn't have to be in his courtroom to hear
him be his usual obnoxious self (the guy has no social skills-he reminds me
of a junk yard dog). And his rant about the damn hyphens-the guy must be a
frustrated English teacher. I can't wait till he comes up for
re-appointment. We should ream him when the time comes. Maybe we should put
a fund together to pay for him to get his teaching credential so he can be
his usual arbitrary and capricious jerk ass self with someone else besides
our clients. "
Example 2
" I had a bad outcome with Judge Mc again. I need some advice in how to
help my client who got what I think is an extremely unjust result. I'm
quite sure he didn't read the pleading, he didn't rule timely and he didn't
give a reason for denying my petition. The facts are as follows
slfjlasjdfljasldkfjalskjflasjfjslkdjflksd. I am really frustrated with the
results that my clients get in his courtroom. Please either post your
suggestions to the list or contact me off list. TIA"
The first one should have been a phone call to a trusted colleague to vent
some steam-probably with many additional colorful adjectives (but without
the Mick appellation). After the steam is gone, it is much easier to then
post to the list serve like the second example. Any campaign to keep a
judge from reappointment can be effectively done off list. You'll get the
same result and their will nothing there to come back and bite you or cdcbaa
in the butt.
If you have any questions or concerns, please contact me.

I notice that the subject of this thread is now "Re: professional behavior";
so, I apologize if anybody believes that my comments may affect their
reputation.
To be sure, however, my criticism of a judge's policies or decisions are
always made with all the respect warranted by the position of Judge,
regardless of the particular judge. I do not make a comment here that I
would not more than gladly thank heavens for the opportunity to tell it to a
Judge in a courtroom or outside of it. I served for a District Court Judge
and for three Bankruptcy Judges in the 90's and I've taken classes on ethics
for law clerks from Judge Mund and others in the past; so, I would hope I've
learned something from such classes.
Needless to say, I do not believe that all the members of this listserv
share or endorse any of my comments.

My two cents;
This is from a person who has very little hair left.
I think a professional forum is the place to discuss matters that can assist
our clients. HOWEVER, we are officers of the court and are expected to act
accordingly. As a practical matter, it does not help yourself or your
clients to speak improperly of anyone, from clerk to Judge.
I treat everyone with respect and professionalism. Not only is it the
correct thing to do but it is a requirement of our profession.

Because this is a public forum for a professional association. We grey hairs don't want our reputations tainted by individual attorney's indescretions. And, btw, we can kick you off the listserve for nonprofessional behavior.
So be professional or you may begone.
