Return of Automobile in pursuant to Ch. 13 Case Filing
Was the case filed before or after the car was repo'd. Then your
choices are either a turnover motion or an OSC re sanctions for
violating the stay.

Hi,
My clients auto was repossessed about one week ago. We filed a
Chapter 13 but the attorney for the creditor insist that they will
not return the vehicle to her because their afraid she will "hide
the car" and not make payments again. Debtor does have full coverage
insurance for the vehicle.
Does anybody have a sample motion to get the creditor to return the
vehicle to the BK estate?

I think Southwestern Leasing case is still good. They always give my clients
cars back even after repeat filings, but they make them pay the repo
