Is it too soon to file a Motion for Abandonment under these facts:
Ch. 7 case filed, 341a meeting held. Trustee files no asset report. Trustee retracts no asset report because he thinks he can sell debtor's real property for more than exempt value. Debtor has appraisal to the contrary. Case is still open and awaiting discharge.
I know Trustee is going to try to extort money from the debtor to "settle" the matter and I'd like to head this off at the pass.
THoughts?
