Dennis,
I know we touched on the Lamie case's impact on pre-petition contracts
and known post petition services in our last meeting, but I would like
to see a more extensive discussion of the issues it creates for post
petition representation for services not anticipated or determinable
pre-petition, such as stay violation actions, discharge injunction
violations, adversaries against the trustee, etc. My reading of the
case is that we have to get the trustee to hire us to rep our client,
which means they decide whether our client can take any particular legal
action.
