FILING CASES IN SOUTHERN DISTRICT
The Southern District is a different animal. Do not assume that any
of our local Chapter 13 rules apply. I like to use Cory Briggs or
Michael Gardner for bankruptcy practice down there.
Good luck. Lou Esbin

Ivan Trahan used to practice in Ventura and San Diego. He went back to San Diego fulltime and is a good contact for your Southern District needs. Gautschi

Does anyone have any information as to policies/practices by the
Southern District regarding the use of appearance attorneys for both
Chapter 7 and Chapter 13 cases. Paul Winkler tells me (although he
says he's not really sure) that THEY DO NO LIKE APPEARANCE ATTORNEYS
THERE AT ALL and that as a matter of fact, they make attorneys sign a
declaration stating that they personally met with the client PRIOR to
the 341(a) hearing. Fee disgorgements, apparently, are common when
attorneys don't meet with the clients in person and/or when they use
an appearance attorney for the hearing.
Information, anyone? Also, are there any Chapter 13 attorney fee
limits or is the RARA procedure the same?
If the above is not true, can anyone recommend a good appearance
attorney in that district for both Chapter 7 and Chapter 13 cases?
All answers will be greatly appreciated!
