The form does not ask whether the sponsor ever filed BK. If
sponsor's income is insufficient, co-sponsors or alternative
sponsors can be obtained. You should not have turned that person
away!

Ty,
Ability to sponsor fiance is proven by submitting an I-864 Affidavit of Support and is solely based on the sponsor's income. The form does not ask whether the sponsor ever filed BK. If sponsor's income is insufficient, co-sponsors or alternative sponsors can be obtained. You should not have turned that person away!

I would think, also, that section 525 dealing with bankruptcy
discrimination, deals with the issue.

Brian,
I've got more than twenty of these cases under my belt with no problems
reported by the clients. I've only had one person I turned away. This
person was sponsoring a fiancee for immigration purposes and I told here
that she might not be able to prove to INS that she could financially
support her fiancee if she filed a BK!

I concur, also of the antidiscrimination clause under Title 11.

BK does not affect naturalization. On the form N-600 the question is not
even asked. If she has been convicted of BK fraud (fed. felony) that would be
an issue.

No. FYI, most naturalized citizens also petition other family members to
come into the U.S. at which point an Affidavit of Support is submitted
to the INS (now called the BCIS) attesting that the petitioned alien
would not be a burden to the government. However, this affidavit is
supported by the petitioner's income alone (if insufficient, alternative
sponsors could be obtained to sign the affidavit) and the issue of
whether the petitioner ever filed BK does not even come up in that
instance.

I have had this issue before. As far as I know, as long as there is no fraud
should be no issue. INS cares about taxes and fraud.

Potential client wants to file a ch 7. She is a resident alien, here
legally. She is in the process of becoming a naturalized citizen of
the U.S. No criminal background, no potentially non dischargeable
debts.
Does anyone know whether a bk filing could adversely impact the
naturalization process? Thanks.
