Subject: [cdcbaa] 2-people-Seperate households-marrrage penalty?
Greetings:
Consider if you will the following:
Husband & Wife, - separated, separate households, have for some time
(more than 6 months)
Bankruptcy filed jointly; limited assets, contested personal injury
claim -wife
Husband has Intellectual property of undetermined value, screenplay-
never marketed.
Both elect 703 exemptions,
Trustee (Amy Goldman) contends that because they are still married
and elected to file jointly they must share a single set of 703
exemptions.
Is anyone aware of Authority for this proposition? Or preferably
supporting my position that 703 exemptions are individual-
Opinions in the absence of authority?

Check CCP sections 703.110 and 703.140. Married means one set of exemptions
for both.
