PD was offered a reaffirmation agreement by Wells Fargo at interest below the contract amount. Client agreed the reaffirmation after a month of going back and forth. Signed the reaffirmation and sent it to Wells and started making payments since Sept. 2012 to present.
Now wells files a MFRS to take the automobile because they claim that the payments based on the new Reaffirmed amount, not the original contract amount, and that WFDS never signed the reaffirmation.
Basically trying to muscle and renegotiate the terms or move to repo.
Can I move to enforce their proposed reaffirmation relied upon by the PD, and since the fact that PD has made payments and they have accepted payments since September 2012-January 2013.
Also, can I ask for 17b sanctions for such underhanded business practices by WFDS
I am even willing to proceed with an adversary I am so sick of WFB.
Your suggestions would be appreciated especially since I am not being very objective.
